Dear Congressman Miller:
I am responding to your letter of August 2,1993, in which you requested that the study on the safety of plutonium sea shipments, required by Section 2904 of the Energy Policy Act of 1992 (Public Law 102-486), also address the environmental risk associated with shipments of high-level nuclear waste in glassified form. Section 2904 requires the President, in consultation with the Nuclear Regulatory Commission, to conduct the study ord to transmit a report on the study to Congress.
Since the President delegated to the Secretary of Energy the responsibilities for preparing and transmitting the report to Congress, we believe it is appropriate to allow the Secretary to take the lead in responding to the specific questions in your letter. We understand that Secretary O' Leary plans to transmit the study originally specified to Congress on September 30, 1993, and will follow up with a supplemental report on the questions you raised. As in the original study, the NRC expects to participate in the review of the supplemental report.
