Dear Mr. Chairman:
On March 3, 1993, the Commission appeared before the Subcommittee on oversight and Investigations concerning fire protection at nuclear power plants.
At the hearing, the question was raised about whether there was misconduct or dereliction of duty on the part of NRC employees in approving the use of Thermo-Lag 330-1 as a fire retardant in nuclear power plants.
The NRC Inspector General has concluded that the NRC staff review of fire endurance and ampacity rating information concerning Thermo-Lag 330-1 in 1982 was inconsistent and inadequate.
The IG's investigation of fire barrier matters is continuing, but the Inspector General has not found personal misconduct by any NRC employees during that time period.
The staff has acknowledged that in the past it missed several opportunities to identify and raise to management's attention generic implications of the fire protection issues discussed at the hearing.
The need for individual staff members to identify and report potential generic implications of issues in performing technical reviews has been communicated to appropriate members of I
the licensing and inspection staff.
Therefore I conclude that there has not been misconduct or dereliction of duty.
We plan to apply all the lessono learned from this experience toward enhancina our fire protection programs in order to further reduce the potential for fires at NRC-licensed nuclear power plants and other NRC-licensed facilities.
We will inform you of any additional actions we believe necessary after we review the IG's conclusions.
