- PROPOSED RULE ON ALWR BEVERE ACCIDENT PERFORMANCE The Commission (with all Commissioners agreeing) has approved the staff recommendation to delay a decision on the need for generic rulemaking to address severe accidents at least until after the Final Safety Evaluation Reports (FSER) are issued for the ABWR and the System 80+.

If needed, the generic rulemaking for these issues in Part 50 should follow completion of the revisions to 10 CFR 50 and 10 CFR 100 which address siting and source terms.

The staff should continue discussions with the ACRS concerning generic rulemaking and monitor progress of the reviews of evolutionary and passive designs.

After the FSERs have been issued for the ABWR and the System 80+ and there has been some further experience with plant-specific design certification i

rulemaking proceedings, the staff should provide the Commission a recommendation on the need to pursue generic rulemaking.
