Commission is SECY-93-254, Vermont Yankee Nuclear 7
Power Corporation, Licensing Board memorandum 8
regarding termination of licensing amendment 9
proceeding.

10 The Commissio.' is being asked to act on a t
11 memorandum and order that provides additional guidance 12 for the staff and Licensing Board in reponse to the 13 issues in Licensing Board Panel 93-16.
14 All the Commissioners have approved the 15 memorandum and order, attached to our September the 16 16th memorandum.
The memorandum and order notes that 17 the Licensing Board was correct in concluding that it 18 lacked jurisdiction to address the issue of the 19 withdrawal of the licensing amendment, however, the 20 Board erred in concluding that staff approval of 21 Vermont Yankee's withdrawal request had the ef fect of 22
" terminating the proceeding".
The Board itself has l
23 the jurisdiction to terminate the proceedings.
