By letter, dated September 22, 1993, Complainant requests modification of the hearing schedule because of witnesses' work-related scheduling conflicts.
The hearing was to begin on October 26, 1993, as ordered on July 7, 1993.
A telephone conference was held with the parties, on September 24, 1993, and they agreed: that the hearing shall begin on November 16, 1993; final pretrial stipulations and/or statements and the exchange of exhibits and witness lists shall take place by October 12, 1993; and responses to exchange of lists, including objections to witnesses and/or exhibits shall be filed by October 19, 1993.
These dates would supersede the respective dates in the order of July 7, 1993.

. By letters, dated September 28, 1993, Complainant requests permission to have its witness Alan Herdt deposed on October 26, 1993, in order to preserve his testimony for the hearing, beginning November 16, 1993, and to have the deposition testimony introduced at the hearing.
Mr. Herdt is expected to testify about Defendant's time and attendance submissions and an investigation concerning the matter.
The witness' schedule conflicts with the November 16 hearing schedule.
Counsel for Defendant agrees to.this proposed procedure.
A sufficient showing has been made to grant the relief sought.
Based on the foregoing, it is hereby Ordered:
1.
The hearing shall commence at 9:30 a.m. on November 16, 1993 in the Nuclear Regulatory Commission Hearing Room, Fifth Floor, 4350 East West Highway, Bethesda,

Haryland.

Final pretrial stipulations and/or statements and the exchange of exhibits and witness lists shall take place by October 12, 1993; and responses to exchange of lists, including objections to witnesses and/or exhibits, shall be filed by October 19, 1993.

Alan Herdt shall be deposed on October 26, 1993 in order to preserve his testimony for hearing.

videotaped.
It shall constitute his testimony and be introduced at hearing.

The July 7, 1993 hearing schedule is modified accordingly.
