Dear Judge Margulies:
As a result of the telephone conference on September 24, 1993, betusen the court, counsel for Mr. Zerr, and counsel for the NRC, the hearing date in the above reteranced matter was conditionally changed to Novembar 16-19, 1993, subject to witness confirmation by the NRC.
The NRC has contacted all of its witnesses and confirmed that the new hearing date will not create any unavoidable scheduling conflicts except as to one witness, Mr. Alan Herdt.
Mr. Hardt has advised NRC counsel that he scheduled a wedding anniversary trip the week of November 15, 1993, and cancellation would result
- in the loss of thousands of dollars.
The parties have agreed, subject to this Court's approval, that this witness will be deposed on October 26, 1993, in order to preserve his testimony for hearing.
Therefore, pursuant to 10 C.F.R. 5 13.33(b), the NRC respectfully requests permission to depose Mr. Hardt and to introduce his deposition testimony at hearing.
