Meade Call Box 1021 7S Urban Avenue Westbury, New York 11590-0139 Gentlemen: I am responding to your letter dated October 15, 1992, in which you requested an extension of time to file for termination of your Quality Assurance Program Approval No. 0166 for purpcses of avoiding the FY 1993 annual fee. We advised you in our November 6,1992, acknowledgement letter that we would notify you of our decision'once the FY 1993 annual fee rule became effective. The final rule was issued in the Federal Register, on July 20, 1993, and became effective August 19, 1993. The bases for your request are:

1) you did not know you had to terminate your "QA" by September 30, 1992, to avoid the FY 1993 annual fee, you were told you had until September 1993; 2) you filed for termination of your materials license on January 15, 1992, and thought this was your only license; 3) you were under the assumption that without the materials license you could not

) transport material (reason for the "QA" program); 4) the invoice said non-payment of the fee may result in revocation; 5) you did not know what License 0166 was since on NRC Form 311 there is an Approval No. 0166, not a license number; and, 6) you filed for termination of your Quality Assurance Program Approval No. 0166 on October 9, 1992. Based on the.information provided the Transportation Section staff has verified that if they had been notified in January 1992 that you were terminating your materials license, they would have been able to terminate your QA Program Approval at that time. Based on the foregoing, the Commission: 1) grants a 9-day extension to the period of time to file for termination for purposes of avoiding the FY 1993 annual fee; 2) acknowledges that all licensed activities had ceased prior to September 30, 1992; ano,

3) acknowledges that Quality Assurance Program Approval No. 0166 was terminated October 27, 1992.

At this time we are requesting exemption from the above mentioned invoice for the following reasons: 1. We did not know that we had to terminate our "Q.A." license by September 30, 1992 so we would not be invoiced for 1993. We were told by Pius Akinola that we had until September 1993. 2. He terminated our liaterial License 31-02933-01 on January 15, 1992 and thought this license was our only license with the NRC. We were under the assumption that if we did not possess material (material license) we could not transport the material (reason for Q.A. You cannot have one license without the other. program). 3. The invoice also states on the bottom "non payment of your fee may result in the revocation of your license." Why hasn't our license already been revoked.

4. On NRC Form 311 of the Q.A.

Program there is an approval nL aber 0166, not a license number. When we first received invoices for the Q.A. Program we had no idea what License No. 0166 was, the only number we used was 31-02933-01, our material license. Due to these rough economical times we would greatly appreciate your allowing our exemption for the payment of the 1993 invoice. i Thank you for your assistance in this matter and we look forward to your reply.
