Dear Mr. Chernoff:
By letter dated January 28, 1993, the U.S. Department of Energy (D0E) transmitted copies of the Final Long-Term Surveillance Plan (LTSP) for the Spook, Wyoming, Uranium Mill Tailings Remedial Action (UMTRA) Project site.
This was supplemented by letter of April 19, 1993, from Jacobs Engineering Group Inc., and your letter of September 15, 1993. All of the U.S. Nuclear Regulatory Commission staff's open issues have been adequately addressed in the final document resulting from these submittals. The LTSP satisfies the requirements set forth in the Uranium Mill Tailings Radiation Control Act of 1978 for long-term surveillance of a disposal site, and all requirements in 10 CFR Part 40.27 for an LTSP.
The NRC staff hereby accepts the LTSP for the Spook, Wyoming, UMTRA site, and by this action, considers the site to be subject to the general license in Part 40.27.
Since the Spook, Wyoming site is one which has been stabilized in place, the LTSP may need to be amended following DOE's selection and performance of groundwater remedial action.
In accordance with DOE's guidance document for long-term surveillance, all further NRC/D0E interaction on the long-term care of the Spook, Wyoming site will be conducted with the Grand Junction Projects Office.
