Dear Mr. Merges:
The purpose of this letter is to propose a potential project for the Conference of Radiation Control Program Director's (CRCPD) E-5 Committee to consider.
It is the Nuclear Regulatory Commission's understanding that the E-5 Committee is currently attempting to establish a joint task force with the Host State Technical Coordination Committee to survey current low-level waste facility container acceptance criteria. As part of this survey it may prove beneficial to establish a data base of State or industry standards for those areas not addressed by NRC regulations. One potential area would be State requirements for the solidification of Class A waste. Once the survey is completed the E-5 Committee may want to consider the next course of action, which could include publishing the survey results for information, recommending a preferred industry standard endorsed by the CRCPD, or recommending that NRC develop guidance and/or regulations to address areas considered important by the E-5 Committee. This guidance could prove beneficial to not only generators and vendors, but also to future host States of low-level waste disposal facilities.
For background information on our above suggestion, NRC offers the following explanation.
The Low-level Waste Management Branch (LLWB) has recently been approached by vendors interested in having NRC review topical reports for Class A solidification processes.
These vendors feel that there are benefits in having a centralized review and approval process. Note that these proposed topicals describe processes that create waste forms that are not required to be stable by the provisions of 10 CFR 61 and the Branch Technical Position on Waste Form. As you know, NRC has no requirement or standards for solidification or stabilization of Class A waste (except for those Class A wastes that are placed with Class B and C waste), but several States are requiring, for waste acceptability, that Class A waste be solidified and/or meet some stability criteria that may be less stringent than that required for Class B and C waste.
LLWB has told vendors that since NRC does not have standards in this area, we are not prepared to perform such reviews unless specifically requested by the States. However, NRC recognizes the concerns being expressed by both vendors and generators in needing uniform standards for waste processing practices that considers future actions such as storage and the ultimate disposal acceptability of the waste.
