PETITION FOR RECONSIDERATION OF ANNUAL FEE RULE Based on new information which I have received since I voted in this matter on August 11, 1993, I now reverse my previous position and vote to grant the Petition for Reconsideration of the Annual Fee Rule submitted by Cornell and other universities on July 30, 1993.
I believe that new information on externalized benefits which colleges and universities have recently submitted to support their applications for individual exemptions indicates that there may be enough such information available to support reconsideration of the Commission's decision on the generic exemption.
I agree with Commissioner Rogers that the staff should prepare a Federal Register notice to publish notice of the petition and the Commission's decision to reconsider the fee exemption for non-profit educational institutions and to request comments on a draft rule.
I believe that in evaluating support for a generic non-profit educational institution exemption, the externalized benefits from educational uses, rather than research uses, are greater and more uniquely associated with the non-profit colleges and universities, and therefore should be given more weight.
I would also note that this decision by the Commission will potentially reverse or make moot certain parts of the staff requirements memoranda on COMSECY-93-033 REMANDED ISSUES CONTAINED IN FISCAL YEARS 1991-1993 ANNUAL FEE RULES and COMGD 005/COMFR-93-004 DEVELOPMENT OF CRITERIA FOR PUBLIC INTEREST EXEMPTIONS FROM THE 1993 FEE RULE.
