Dear Mr. Chernoff:
The U.S. Nuclear Regulatory Commission _ staff has completed its review of the final Remedial Action Plan and Site Design (RAP) and all associated documentation pertinent to the proposed remedial action for the inactive uranium mill tailings site at Gunnison, Colorado. The documentation reviewed included page changes to the RAP which were transmitted by the Department of Energy (DOE) letters dated August 4, and September 10, 1993. Our review is documented in the enclosed Technical Evaluation Report, which discusses the NRC staff's evaluation of the proposed remedial action for compliance with the Environmental Protection Agency standards in 40 CFR Part 192, Subparts A-C.
Based on our review, the NRC staff concurs in the Gunnison RAP. We will execute the concurrence upon receipt of the apriopriate DOE-signed signature pages. DOE's proposed remedial action at the Gunnison site complies with l
Part 192, Subparts A-C, with the exception of selection and performance of a groundwater cleanup program. DOE has proposed deferral of this aspect of the remedial action at this time, and plans a separate groundwater restoration program. The NRC staff considers this deferral to be acceptable.
