(NRC INSPECTION REPORT NO. 999-90002/93-01)

This letter refers to the Enforcement Conference held at our request on September 8, 1993. This meeting concerned activities authorized for your Coal Mountain, West Virginia facility. The issues discussed at this conference related to the removal of a fixed nuclear density gauge from its inst:lled location by an individual not licensed to perform such activities. A list of attendees and a copy of your handouts are enclosed. We are contbuing our review of these issues to determine the appropriate enforcement action.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and its enclosures will be placed in the NRC Public Document Room.

A OPERATING and SAFETY INSTRUCTIONS At the time of start-up, KAY-RAY or its specifically licensed representative will inform the customer of'the limitations of the general licensing arrangement under which this gauge has been distributed. These limitations are outlined belos. A copy or toese regulations is also attaened to each~ source holder on a metal plate. For'your information, these restrictions are given:below.
