Since the Commission made its j

decision on the FY 1993 annual fee rule, much additional information has become available from the educational institutions, including the Petition for Reconsideration.

To date, we have heard primarily from the non-power reactor licensees; I believe we have yet to hear from the material i

licensees at educational institutions, some of whom may be affected by fees even more severely.

.I Regrettably, granting the petition will result in confusion j

amongst our licensees and embarrassment to the agency.

However, not granting the petition will compound what I consider an l

unfcrtunate mistake.

I believe that case by case exemptions will result in greater confusion, claims of inequity, loss of fee l

recovery, extensive litigation, and an unwarranted expenditure of i
