EM 93-083 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCFMENT ACTION Licensee:
Cleveland Electric Illuminating Company (EA 93-176)

PROPOSED IMPOSITION OF CIVIL PENALTY - $200,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $200,000 will be issued on or about August 31, 1993 to the Cleveland Electric Illuminating Company.
This action is based on the licensee's failure to correct cleanliness problems in the i
suppression pool and drywell which resulted in the clogging of the RHR system suction strainers as well as on the licensee's inadequate corrective actions once those problems were initially identified.
The resulting corrective action violation which inclades three examples has been classified at Severity Level III.
The base civil penalty of $50,000 has been escalated a total of 300 percent.
Escalation of 50 percent was warranted for NRC identification, 50 percent mitigation was warranted for the licensee's ultimate corrective actions, 100 percent escalatian was warranted for the licensee's past poor performance, 100 percent escalation was warranted for the prior opportunity to identify the problem earliec provided by an NRC information notice, and an additional 100 percent escalation was warranted for the duration of the problem which extends back to 1c87.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice August 31, 1993 Telephone Notification of Licensee August 31, 1993 The State of Ohio will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
