SUBJECT:
FINAL SAFETY EVALUATION REPORT FOR VOLUME III 0F THE ELECTRIC POWER RESEARCH INSTITUTE'S ADVANCED LIGHT-WATER REACTOR REQUIRE-l MENTS DOCUMENT PURPOSE:
To inform the Commission of the staff's intent to issue its final safety evaluation report (FSER) on the staff's review of Volume III of the Electric Power Research Institute's (EPRI's) Advanced Light Water Reactor (ALWR)
Requirements Document.
BACKGROUND:
EPRI has prepared a compendium of technical regt.irements, referred to as the ALWR Utility Requirements Document (Requirements Document).
These require-ments apply t; the design of future ALWR power plants.
The Requirements Document consists of three volumes.
Volume I, "ALWR Policy and Summary of Top-Tier Requirements," is a management-level synopsis of the Requirements Document, including the design objectives and philosophy, the overall physical configuration and features of a future nuclear plant design, and the steps necessary to apply proposed ALWR design criteria beyond the conceptual design state to a completed, functioning power plant. consists of 13 chapters and contains utility design requirements for an evolutionary nuclear power plant [approximately 1350 megawatt-electric (MWe)].
i Volume III consists of 13 chapters and contains utility design requirements for nuclear plants (approximately 600 MWe) using passive design systems and features.
DISCUSSION:
In April 1992, the staff issued draft safety evaluation reports (DSERs) on all chapters of the Requirements Document (Volume III) for passive plant designs.
The staff continued its review after issuing the DSER, including consideration of EPRI changes through Revision 4 to Volume III of the Requirements Document.
This FSER documents the staff's final conclusions from its review of the Requirements Document for passive plant designs.
l The staff is submitting these documents in accordance with the Commission's direction in the staff requirements memorandum (SRM) of December 15, 1989, on l
SECY-89-334, " Recommended Priorities for Review of Standard Plant Designs."
In the SRM, the Commission stated the following:
l The SERs on the EPRI Requirements Document for both the evolution-l ary and the passive plant designs should be submitted to the ACRS l
for review and comment and to the Commission for information and for review and approval of policy issues for which the Commission l
has not previously decided.
l This direction is included as an element of the process described in SECY-90-065, " Evolutionary and Passive Advanced Light Water Reactor Resources and Schedules," and SECY-93-097, " Integrated Review Schedules for the Evolu-tionary and Advanced Light Water Reactor Projects."
j In SECY-93-097, the staff scheduled issuance of the FSER to the Commission and
'l the Advisory Committee on Reactor Safeguards (ACRS) for the end of July 1993, with formal publication as Volume 3 of NUREG-1242 scheduled at the end of i'
November 1993.
This four-month period will allow the Commission and the ACRS to review the proposed FSER and make comments. This FSER documents the l
completion by the staff of its review of Volume III of the Requirements Document. This FSER contains references to Commission papers that have not been provided to the Commission. Complete Commission paper titles and SECY designations will be updated before the FSER's final publication. This FSER i
will provide useful guidance to the passive plant vendors whose applications for final design approval / design certification are currently under staff review. The staff will notify the Commission of any substantive changes to 1
major technical issues resulting from the ACRS or Commission reviews before j
final publication in November.
The staff has identified issues for which it proposes to depart fron current regulations or is substantially supplementing or revising the interpretive l
guidance applied to currently licensed light-water reactors. The staff addressed these issues for passive plant designs in SECY-93-087 and in the

t draft policy papa " Policy and Technical Issues Associated with the Regulatory l
Treatment of Non-Safety Systems in Passive Plant Designs," which will be l
forwarded to the Commission for information shortly. The staff considers the discussions in these papers to be the regulatory departure analysis of the policy issues for the passive plant designs. The staff will include the text of these Commission papers in f.ppendix B of the FSER. The staff is writing l
other Commission' papers on issues associated with the new physically-based l
source term and emergency preparedness for passive plant designs. Discussions of these issues will be included in the final published SER or in published SER supplements.

CONCLUSIONS:
The staff concludes that the enclosed FSER on Volume III should be forwarded to EPRI to inform EPRI of the staff's findings and to describe the resolution of the technical issues identified in the DSER.
i Accordingly, the staff will issue the enclesed FSER 3 work days from the date I
of this paper. At that time, the staff will place this document in the NRC i
Public Document Room.
