I r e I i Comments of Commissioner Remick on SECY-93-205 I approve the proposed Memorandum of Understanding (MOU) between i the U.S. Food and Drug Administration (FDA) and NRC, provided that the staff makes two modifications to the proposed MOU. i I First, the staff should ensure that the definition of nuclear material covered by the MOU is used consistently and f appropriately throughout the MOU. In some places, the MOU refers i only to by-product material, while at other times it refers to j by product, source, and special nuclear material, or nuclear and i other radioactive materials. Second, the staff should ensure that the MOU adequately considers the recent proposal of using boron neutron capture therapy for the treatment of brain cancer. l l With the appropriate modifications made to accommodate these two i l concerns, I approve the subject NRC/FDA MOU.
