The Nuclear Regulatory Commission has sent to the Federal Recister for publication the enclosed, " Withdrawal of Below Regulatory Concern Policy Statements and Related Rulemaking i

Actions."

The NRC is formally withdrawing its Below Regulatory Concern (BRC) policy statements.

Specifically, this action i

removes the BRC Policy Statement issued on July 3, 1990, and the BRC Policy issued in 1986 concerning the submittal of petitions f

for disposal of radioactive vaste streams below regulatory concern that were set out in the Commission's regulations.

,.The Commission is also terminating a rulemaking action initiated to l

implement the 1986 BRC Policy.

l This action is necessary to comply with provisions of the Energy Policy Act of 1992.

This action is effective upon publication in the Federal I

Recister.
