Dear Governor Sullivan:
Over a year ago, you forwarded to me Wyoming's comments on the Nuclear l
Regulatory Comission's proposed guidance regarding disposal of material other than Section lle.(2) byproduct material in uranium tailings impoundments and the processing of alternate feed stocks in uranium mills (57 f3 20525, May 13, 1992).
In my August 10, 1992, response, I stated that the NRC staff would prepare a recomendation for Comission consideration after evaluation of the public coments we received and that the Commission anticipated reaching a final decision by the ena of 1992.
I also promised to provide you copies of the staff analysis and our final decision.
Unfortunately, the complexity of severa' # the issues raised by the guidance has significantly delayed the NRC staff' afforts to complete its evaluation and prepare its recomendations for Commission consideration.
It now appears likely that the staff's recommended approach to developing final guidance probably will not be presented to the Commission until early 1994.
The Comission recognizes that the proposed guidance is a matter of concern to you and the people of Wyoming and we regret any inconvenience that the delay in reaching a final decision may be causing you.
I can assure you that after the Comission has completed its review of the guidance, we will provide you copies of the si.aff analysis and our final decision.

1 By letter dated July 2,1992, you transmitted Wyoming's coments on the U.S. Nuclear Regulatory Comission's proposed guidance regarding disposal of material other than Section 11e.(2) byproduct material in uranium tailings impoundments and the processing of alternat 4 feed stocks in uranium mills (57 EB 20525, May 13, 1992). My August 10, 1992, response to you stated that the NRC staff would prepare a recomendation for Comission consideration after evaluation of public coments, and that we anticipated reaching a final decision by the end of 1992.
I promised to provide you copies of the staff analysis and our final decision.
Because of the complexity of several of the issues raised by the guidance, which the NRC staff is in the process of resolving, the staff recomendation for the finalization of the guidance probably will not be presented to the Comission until early 1994. After the Comission has completed review and deliberation of the proposed guidance, we will be pleased to provide you copies of the staff analysis and our final decision.
