Dear Mr. Feldman:

By letter of June 9,1993, Mr. Charles A. Newman submitted your affidavit dated June 8, 1993. By letter of June 23, 1993, we informed you of our conclusion that the documents covered by the affidavit did not meet the requirements of Title 10 of the Code of Federal Regulations, Section 2.790(a)(4), with the exception of limited portions of the following documents.

In a letter of July 7,1993, Mr. Newman responded on your behalf to our letter of June 23, 1993.

In his letter, Mr. Newman stated that you did not challenge the staff's determination and provided, as requested, non-proprietary versions of the documents listed above. We reviewed these documents and their non-proprietary versions and do not object to the deletion of portions determined by TSI to be proprietary. Therefore, the versions of the documents determined by the NRC to be proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

l The staff will release and place in the NRC Public Document Room the non-proprietary versiens of the documents listed above and the documents listed below.

The letter of October 5,1991 and its Appendices I, III, IV, V, VI, VII, VIII, IX, X, and XI, The letter of November 12, 1991 and its four attachments, and The letter of December 3,1991, and its Enclosures 2, 5, 7, 8, and 9.
