SUBJECT:
PUBLICATION OF FINAL RULE In accordance with the authority delegated to the Executive Director for Operations (ED0), on May 5,1993, the ED0 approved a final rule amending sections of 10 CFR Parts 50 and 54 to clarify references to an already existing reporting requirement.
Please implement the ED0's action by arranging for publication of the enclosed final rule in the Federal Register.
Also, enclosed for transmittal to the PDR are the summary and staff response to public comments and the regulatory analysis for the amendments. The letters to the appropriate Congressional subcommittees are also attached.
A daily staff note has been submitted to the ED0 to notify the Commission.

Aporoved for Publication The Commission delegated to the EDO (10 CFR 1.31(c)) the authority to develop and promulgate rules as defined in the APA (5 U.S.C. 551 (4)) subject to the limitations in NRC Management Directive 9.17, Organization and Function, Office of the Executive Director for Operations, paragraphs 0213, 038, 039,.
and 0310.
The enclosed rule will amend 10 CFR 50.54(a)(3) and 10 CFR 54.37(b) to apply consistently the reference to the requirement of 10 CFR 50.71(e) for the frequency of FSAR update submittals.
This final rule does not constitute a significant question of policy, nor does it amend regulations contained in 10 CFR Parts 7, 8, or 9 Subpart C concerning matters of policy.
I, therefore, find that this rule is within the scope of my rulemaking authority and am proceeding to issue it.
