Dear Mr. Adams,

In response to concerns about Bud ng 97, voiced in a 10 August 1993 convers'ation between Peter Cornetta at., yourself, the following inforca: ion is provided.

Amendment No. 9 for Facility License R-65 was issued in response to an amendment request dated January 13, 1971. This amendment requested authorization to possess, but not operate, the nuclear reactor and was part of the Deactivation Report of the Army Materials Pesearch Reactor dated December 8, 1970. This report includes specifications for the facility in a deactivated condition.

Aruendment No. 9 authorized the facility to be possessed in conformity with this application (Deactivation Report), indicating that the liquid waste system in Building 97 be transferred to Byproduct material license Number 20-01010-04.

The syst em was disconnected f rom t he cont ainment shell and the 40,000 gallon retention tank between Building 97 and the reactor shell was drained and flushed clean to the Metropolitan District Commission sanitary sewer. The reactor plant area was defined to include only the reactor containment ahell. Subsequently, Building 97 was included in the Byproduct Material License.

A copy of the 2 April 1973 application for renewal of Byproduct Material License Number 20-01010-04 is enclosed along with the NRC letter dated April 3, 1971, the Deactivation Report and Amendment 9 to Facility License R-65.
