DENIAL OF EXTENSION OF RECIPROCITY RECOGNITION i
This is in response to your June 15, 1993 letter and completed NRC Form 241 l
(Report of Proposed Activities in Non-Agreement States), requesting permission to perform licensed activities in NRC States or Territories under reciprocity pursuant to 10 CFR 150.20. The NRC previously granted reciprocity to you for j
the 1993 year, and it is our understanding that.you have been using materials j
pursuant to this approval and 10 CFR 150.20 since January-1,1993.
As a result, you were authorized to conduct licensed activities in NRC jurisdiction l
for 180 days from January 1, 1993.
Your letter, however, requests that i
February 17, 1993,- the date a new license (Florida 2335-1) was issued to you, be' recognized as-the beginning date of use of licensed materials within NRC L
jurisdiction.
i We have determined that Southern Industrial Testing, Inc.,' meets the
' definition of " person" in 10 CFR Part 150, and, under this newly issued license, is the same person as named in the previously issued license.
Accordingly, we have determined that the start of reciprocity recognition for calendar year 1993 was January 1,1993, and your request for using the date of February 17, 1993, is hereby denied. This decision was previously
.communjcated to you in a telephone conversation with Mr. David Collins of my
- staff on or about June 25, 1993. Your check (marked void) dated June 14, 1993, which was submitted with your request, will be returned to you via NRC's License Fee & Debt Collection Branch.
We understand that Southern Industrial Testing, Inc., has possessed licensed i
materials in a'reas of NRC jurisdiction on each day since January 1,1993.
Therefore, on June 30, 1993, having completed 180 consecutive days in calendar year'1993, Southern Industrial Testing, Inc., was no langer authorized pursuant to 10 CFR 150.20 to possess or use licensed materials in areas where NRC retains jurisdiction for the balance of calendar year 1993.
We' unde'rstand that Southern Industrial Testing, Inc., filed an application for license with NRC Region IV at Arlington, Texas, April 6,1993-and that our Region'.IV office has been in contact with you concerning that application.
You may file 4 Report of Proposed Activities in Non-Agreement States to be effective January 1,1994, for 180 days in calendar year 1994, based upon your Florida Agreement State license and 10 CFR 150.20.
Your application should be filed with this office and be accompanied by the appropriate fees and license documents.
