Dear Mr. Williams:
SUBJECT:
REVIEW REQUESTED OF NRC CONTRACTOR DOCUMENT POSSIBLY CONTAINING APPLIED TECHNOLOGY MATERIAL ON THE MODULAR HIGH-TEMPERATURE GAS-COOLED REACTOR (MHTGR) DESIGN Enclosed is Technical Evaluation Report (TER) 2-2-93, " Evaluation of Computer Codes Used to Calculate MHTGR Accidents Dose Consequences" on the General Atomics codes used to evaluate the radiological consequences of accidents for the MHTGR design. This document was developed for the Nuclear Regulatory 1
i Comission (NRC) by a contractor.
We are preparing to issue this document to the public and the NRC service list i
I for the MHTGR design for comments; however, the contractor relied on informa-tion submitted by the Department of Energy (DOE) and classified " Applied Technology " The Applied Technology label states that " distribution by any l
holder of this Document or of Other Data Herein to Third Parties Representing foreign Interests... Shall be Approved by" DOE.
Because public access to this document may include foreign interests, we request that you have this document reviewed to determine if there is any " Applied Technology" informa-tion on the MHTGR design which should not be provided to the public. The request for such a review of any NRC document was discussed and agreed to in l
the meeting of July I,1993, between NRC and DOE. The summary for this meeting will be issued by NRC in the near future.
To meet our schedule to complete the final Preapplication Safety Evaluation Report (PSER) for the MHTGR design, you are requested to review this document and provide comments concerning the " Applied Technology" information in the document within two weeks of receipt of this letter. We also request that you provide these comments by letter listing the specific sentences and paragraphs in the document that should not be provided to the public. This is not a request for your review of the technical merits and conclusions of the report.
You will be provided an opportunity at a later date to provide such comments I
when we issue the document to the public.
This document is only being provided to you at this time and will not be sent y g to the NRC public document room as part of this letter.
