The subject invoice is for the annual fee prescribed by the regulations for licensees or any organization that maintains a Quality. Assurance program under 10 CFR Part 71 for constructing or maintaining type B packaging for the transport of radioactive material.

Cintichem, Inc., as the owner and primary user of the packaging certified under COC 5957, 6058 and 9098 was required to establish and maintain such a plan.

The referenced Cintichem correspondence dating back to January 1992 is evidence of Cintichem's attempt to advise the NRC of its divestiture of this packaging to the USDOE and also of its l

relinquishment of the management responsibility of its ownership and maintenance.

The referenced NRC correspondence dating back J

to July 23, 1992 is evidence of NRC's recognition of this 1

situation however the License Fee and Debt Collection Branch will only recognize our letter of January 25, 1993 for the purpose of the annual fee assessment.

I am appealing to your reasonable consideration of this matter.

We request that Cintichem be excused from the requirement to pay.

(b) Cintichem, Inc. letter, JJMcG, dated Dec. 28,.1992 (c) USNRC letters July 23, 1992 and Jan. 13, 1993 Cintichem, Inc., in the course of doing business as a supplier of radioactive chemicals, owned and was the principle user of three Type B packagings with the certifications 5957, 6058 and 9098.

This business was terminated in 1990' and ownership of these 3

packagings was transferred to the U.

S. Department of Energy on November 26, 1991.

Transfer of possession of the 9098 and 6058 packagings was accomplished over several weeks in the first quarter of 1991.

Cintichem, as owner and principal user of these packagings, fabricated, repaired and maintained the 9098 packaging and only performed repairs and routine maintenance as i

required on the 5957 and 6058 packaging.

Since November 1991 i

Cintichem has only been a user of all these-packagings.

This transition from owner to user has been documented in the above referenced correspondence.

Since we have. only been using the 6058 packaging after January 1991 and since we intend to use it for several more months, we need to keep the subject Quality Assurance Plan, but only those l

parts of the plan that are pertinent to the use of packaging need to be effective.

We are no longer required to do repairs or routine maintenance.

Considering the limited amount of time that we will be using this packaging, we believe that this means of complying with the QA requirements of 10 CFR Part 71, as opposed to submitting a revised plan, is reasonable.

Dear Mr. McGovern:

This in response to your letters dated October 8, 1992, and December 28, 1992, regarding Invoice No. AM01764-92. Your December 28, 1992, letter was accompanied by a $1,500 fee which you stated was the prescribed fee as a " user" for your Quality Assurance Prcgram, Approval No. 0109. You referenced your letter of October 8, 1992, as the basis for remitting the $1,500 fee rather than the sum of $62,950 as indicated on Invoice No. AM01764-92. , Neither your October 8 nor your December 28 letter requested that kApprovalNo. 0109 be amended to delete the authorization for i design and fabrication activities. These activities were deleted 4 / ef fective February 16, 1993, based on your request dated (January 25, 1993. Therefore, the balance of Invoice No. AM01764-92 remains due and payable. As of March 15, 1993, $65,721.28 is owed including interest, penalty, and administrative costs. Please note, moreover, that Footnote 1 of 10 CFR 171.16 of the i current regulations states, " Amendments based on applications filed after October 1 of each fiscal year that change the scope of a licensee's program or that cancel a license will not result l in any refund or increase in the annual fee for that fiscal year i or any portion thereof for the fiscal year filed." Accordingly, i under these current regulations, f ee Category 10B(1) would be the appropriate category for the assessment of the FY 1993 annual fee for QA Approval No. 0109. However, the Commission has not yet developed the FY 1993 fee rule.
