Dear Mr. Bishop:
This letter is in response to your May 25, 1993, letter which provided the Nuclear Management and Resources Council's (NUMARC's) views regarding SECY-92-287 and SECY-92-287A, " Form and Content for a Design Certification Rul e. " Your letter provided NUMARC's views on several issues associated with the proposed design certification rulemaking.
Your letter did not contain any new information that would cause the staff to change its recommendations in SECY-92-287A.
The staff intends to publish the proposed design certification rule in the Federal Reaister for public comment after the staff receives the Commission's guidance on SECY-92-287 and SECY-92-287A. The staff will consider any future comments from NUMARC, together with those received as part of that public input. The staff is still considering various options for the form of the Federal Reaister notice used to obtain this input, including the approach discussed in your letter, and it will determine the form of the notice after it receives the Commission's guidance.
The staff welcomes your input to the development of the design certification rule. We will continue to interact with industry in the development of 10 CFR Part 52 implementation issues.
