Dear Mr. Gary:

This is in response to the letter we received from you on July 18, 1993 s

(letter undated) to Chairman Selin of the Nuclear Regulatory Commission (NRC).

You stated concern about the status of your 10 CFR 2.206 petition, in which you had identified offsite emergency preparedness issues near the Three Mile Island Nuclear Generating Station, Unit 1 (TMI-1).

In your letter you requested, on behalf of the Pennsylvania Institute for Clean Air (PICA), that the NRC decide immediately to grant, in part, PICA's request, by " powering down the plant on an interim basis" and that the NRC "take over the investigation" and complete it.

Because the issues you raised involve offsite emergency preparedness and entities not licensed by the NRC (i.e., Dauphin County, Pennsylvania), we requested the assistance of the Federal Emergency Management Agency (FEMA) in responding to your original petition as amended and supplemented by your letters of December 2, 1992, and January 15 and February 14, 1993. While the NRC is responsible for assessing the adequacy of onsite emergency plans developed by GPU Nuclear Corporation and has overall responsibility for regulating operation of TMI-1, FEMA is the Federal agency responsible for assessing the adequacy of offsite emergency preparedness and assisting State and local governments in the preparation of emergency response plans.

In accordance with its regulations, NRC findings on the state of emergency preparedness are based on a review of pertinent FEMA findings and determinations.

For this reason we requested the assistance of FEMA in addressing the offsite emergency preparedness issues raised in your petition.

We have been informed by FEMA that they are actively pursuing these issues with the Commonweaith of Pennsylvania, in particular the Pennsylvania Emergency fianagement Agency (PEMA). We have been informed that FEMA expects to provide a report to us by the end of September 1993. My decision in response to your petitien will be made as soon as practicable following receipt of FEMA's report.
