This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

,

l

Mr. J. York of this office on June 20 - July 17, 1993. The inspection

l

included a review of activities authorized for your North Anna facility. At

the conclusion of the inspection, the findings were discussed with those

,

'

members of your staff identified in the enclosed report.

!

Areas examined during the inspection are identified in the report. Within

i

these areas, the inspection consisted of selective examinations of procedures

I

and representative records, interviews with personnel, and observation of

_

activities in progress.

l

i

Based on the results of this inspection, certain of your activities appeared

to be in violation of the NRC requirements as specified in the enclosed Notice

of Violation (Notice),

i

The violation described in the enclosed Notice is similar to a violation

contained in the Notice sent to you by our letter dated March 10, 1992.

i

Recurring violations are of particular concern because the NRC expects

licensees to learn from their past failures and to take effective corrective

i

actions. Although the NRC does not normally consider monetary civil penalties

j

for Severity Level IV violations, the Enforcement Policy states-that such

!

penalties may be imposed for Severity Level IV violations that are similar to

3

previous violations for which the licensee did not take effective corrective

,

action.

In this case, we have decided not to hold an enforcement conference

i

nor to propose a civil penalty because previous corrective actions, while not

effective, were reasonable. Further, the event, as discussed in the report,

i

has a low probability of occurring and its consequences is of low safety

significance. The latter was based on engineering calculations that showed a

i

tornado generated missile would not restrict the EDG muffler to cause an

,

exhaust back pressure to stop the EDG and make it inoperable.

In your

l

response to the enclosed Notice, you should docum(nt the specific actions

taken and any additional actions you plan to prevent recurrence. We will

review your response, including your proposed corrective actions, and the
