REVIEW REQUESTED OF SECOND NUCLEAR REGULATORY COMMISSION (NRC)
CONTRACTOR DOCUMENT POSSIBLY CONTAINING APPLIED TECHNOLOGY MATERIAL ON THE MODULAR HIGH-TEMPERATURE GAS-COOLED REACTOR (MHTGR) DESIGN Enclosed is Technical Evaluation Report (TER) 2-10-93, " Review and Evaluation of Recent Publications Bearing on the fuels Sections of the Draft MHTGR PSER,"
on 13 recently published documents in the area of MHTGR fuel performance that may have an impact on the draft preapplication safety evaluation report (PSER) for the MHTGR design. This document was developed for the NRC by a contrac-tor.
We are preparing to issue this document to the public and the NRC service list for the MHIGR design for comments; however, the contractor relied on information submitted by the Department of Energy (DOE) and classified
" Applied Technology." The Applied Technology label states that " distribution by any holder of this Document or of Other Data Herein to Third Parties Representing Foreign Interests... Shall be Approved by D0E."
Because public access to this document may include foreign interests, we request that you have this document reviewed to determine if there is any " Applied Technology" information on the MHTGR design which should not be provided to the public.
The request for such a review of any NRC document was discussed and agreed to in the meeting of July 1, 1993, between NRC and DOE. The summary for this meeting was issued by NRC on July 8, 1993.
To meet our schedule to complete the final PSER for the MHTGR design, you are requested to review this document and provide comments concerning the " Applied Technology" information in the document within 2 weeks of receipt of this letter. We also request that you provide these comments by letter listing the specific sentences and paragraphs in the document that should not be provided to the public. This is not a request for your review of the technical merits
.i and conclusions of the report.
You will be provided an opportunity at a later date to provide such comments when we issue the document to the public.
