Dear Ms. LoPrete:

I am responding to your letter of July 12, 1993, to Chairman Selin of the U.S.

Nuclear Regulatory Comission (NRC) about the proposed Cortlandt comuter railroad station.

You expressed concerns regarding the effect of the associated roadway interchange on evacuation plans for a radiological emergency at the Indian Point Nuclear Power Plant.

In your letter you also requested that the NRC " step in" and halt the construction of the proposed station until evacuation and traffic problems are addressed.

The NRC can only impose orders on those individuals or facilities that possess licenses with'the NRC. Accordingly, it does not have direct jurisdiction or authority in.this matter.

With respect to your concerns regarding emergency planning, the NRC and the -

Federal Emergency Management Agency (FEMA) are the two Federal agencies responsible for evaluating emergency preparedness at and around nuclear power plants. The NRC is responsible for assessing the adequacy of onsite emergency plans developed by the utility, while FEMA is responsible for assessing the adequacy of offsite emergency planning and assisting State and local' governments in the preparation of emergency response plans. Although the NRC has no direct authority regarding the proposed railroad station, the concerns you rsised relate to offsite emergency planning. Accordingly, we are forwarding a copy of your letter to FEMA officials for their information and considerd Mn. A copy of the FEMA notification will be sent to you when issued.

We appreciate your concerns and coments regarding emergency planning for the Indian Point Nuclear Power Plant and hope that the above information is helpful.

11 is irresponsible for Metro-North to construct a commuter railroad station with parking br 400 automobHes (uttimately as many as 600) with accer.a from Ins only North-South roadway available to area residents and school buses if there was an incident at Indian Point and evacuation was nopersary Ro 9A, sisc trown as AfD?ny Post Road, is a 2-lane roadway which is already burdened by a significant amount et local trathe as well as school buses that service the areas 5 schools. Metro-Nortn proposes only a trathe light and turn tanes at the station entrance lo accommodate the 6ncreased trattic.1he proposed station H; within a 5 m!!e radius of the indlan Point Nuclear Power plant.

An evacuation ptan, or lack thereof, was one of many concems touched upon at a May 4,19S3 held by Cortlandt Town Supervisor Unda Puglist whict', was attended by Community Isaders, and representatives of the Department of Transportation and Metro-North (press release attached). When asked about an evacuation pian at a Juty 1 environmentalImpact meeting, Metro-North representattves reacted as it this was the first time Indian Point had been mentbned. rm sure it is fair to ass NRC nas not been cortsuffed about the plans for the statlert: the safety of the citflens in the autrou area seems a tse ci h!Ue or no consequence to Metro-North when weighed against the revenues the new s'.8tioS Y!'!! Evacuabon along with numerous einer potentiat problems, otv'd easily be resolved if access to the staten was proviced from tne adjacent 4-lane highway, Route 9. tiowever, the Department of Transportation inststs that funds for this interchange are simply not avaltable.

The indian Point 3 instal ation was recently placed on the NRC's list of problem plagued plants due.to declining performance ard inadequate management. In irght of this it is especially important that the NRC (6tep in and put a batt to the proposed Cortlandt stabon until the evacuation and trathe problems are a$drer. sed ob,ectivety and rCsponsibly.
