SECY-92-244 - UPEATE ON DISPOSITION OF THE r

WEAPONS GRADE NUCLEAR MATERIAL FROM DECOMMISSIONED NUCLEAR WEAPONS The Commission (with all Commissioners agreeing) has approved the staff proposal to continue monitoring and periodically update the Commission on developments of national policy on the disposition of weapons grade nuclear material from decommissioned nuclear weapons.

However, the staff should assess the legal and policy implications involved in a departure from the longstanding U.S.

policy to maintain separation between the nuclear programs of civilian and military activities and provide the Commission a recommended course of action.

In future analysis and updates which address this policy issue, the staff should provide recommendations on how the NRC might best adapt to potential changes in this longstanding U.S.

policy.

In ' addition, the staff should provide a detailed legal and technical analysis to support the conclusion in SECY-92-244 that

" existing Category I fuel facility licensees will have to obtain license amendments" to process and recycle Russian material, and "new safeguards rulemaking and a comprehensive environmental impact statement for the conversion operation and the use of the converted HEU and Pu as LWR fuel would be required."'
