Dear Dr. Shewmon:
I am responding to your letter to Chairman Selin dated April 30, 1993, in which you provided ACRS comments and recommendations on the staff's proposed SALP program changes contained in SECY-93-090.
The ACRS recommended that the Commission establish a periodic feedback mechanism so that it can monitor the anticipated staff progress in improving the SALP program. To obtain feedback on the progress, the staff plans to conduct a public meeting after about two years of experience with the new program. This should provide sufficient time for each licensee to be assessed under the new process. Meanwhile, the staff will continue to aggressively monitor the implementation of the SALP program through the program office oversight and through senior management attendance at SALP Board meetings.
The ACRS also recommended that the Commission adopt a formal appeal process that would permit a licensee to bring grievances regarding the application of the SALP program to the attention of senior management without fear of retribution. The staff believes that a formal appeal process over and above that which is available now to licensees is unnecessary.
Presently, licensees can raise concerns to the regional administrator, NRR management and the EDO, if necessary. To my knowledge, licensee concerns with the appeal process have not been raised through the SALP process, during the. SALP reevaluation public workshop held last September, or in meetings between reaior NRC managers and senior industry representatives. Under the proposed SALP program, licensees may dispute findings they disagree with that are contained in the SALP report.
These will be handled on a case-by-case basis. When information provided by a licensee indicates changes are appropriate, the regional administrator has the authority to revise the SALP report, including the ratings. We believe this approach, along with the other options available to licensee management, will-continue to provide for adequate consideration of licensee appeals.
