Dear Senator Lieberman:
In your letter of July 2,1993, you asked for a status report on issues raised by Mary Ellen Marucci, Coordinator, Concerned Citizens Monitoring Network (CCMN), concerning matters relating to a license amendment by Northeast 4
Nuclear Energy Company (NNECO).
The particular amendment of concern is one for which your constituent petitioned for a hearing.
I addressed these issues in my letters of October 23, 1992, to you and to Senator Dodd, in which I indicated that I would send you and Senator Dodd the results of the Atomic Safety and Licensing Board's (ASLB's) proceedings after the Board issues its decision.
By Decision and Order of July 9,1993, which I have enclosed, the ASLB I
terminated the proceeding.
NNEC0 filed a motion for summary disposition on May 5, 1993.
The Nuclear Regulatory Commission staff filed a supporting motion on May 28, 1993.
CCHN did not file a response to the motions.
The ASLB ruled that no genuine issue of fact remained to be determined by a hearing and, accordingly, granted NNEC0 summary disposition and terminated the proceeding.
CCMN has 15 days from service of the Order to request Commission review, and the Commission would then have 30 days from CCMN's filing to consider CCMN's request for review.
Absent such a request, the Commission has 40 days from July 9 to decide whether to review sua sponte the Board's decision.
I will advise yo1 if there is any change pursuant to the Commission's actions regarding this issue.
