INQUIRY NO 99990001/93-011 AND NOTICE OF VIOLATION 1

This letter refers to the telephone discussions between you and Mr. Steven R. Courtemanche of this of6ce on May 21, 1993, and June 9,1993. The discussions concemed the loss of a 75 microcurie promethium-147 scaled source held under a general license on May 18, 1993.

Areas examined during this inquiry included actions taken by you to recover the source, and your corrective and preventive actions.

Based on the results of this inquiry, it appears that your activities were not conducted in full compliance with NRC requirements. A Notice of Violation is enclosed as Appendix A and categorizes each violation by severity level in accordance with the " General Statement of Policy and Pmeedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, (Enforcement Policy). You are required to respond to this letter and in preparing your response, you should follow the instructions in Appendix A.

The violation described in the enclosed Notice of Violation involving control of licensed material, is classified as a Severity Level IV violation. As indicated in Supplement VI of the NRC Enforcement Policy, signi6 cant violations of this type are normally classified as Severity Level III. However, after careful consideration of the factors involved in this specific instance, we have exeirised ourjudgement under the NRC Enforcement Policy and have classified this violation as a Severity LevelIV based on the limited safety significance that (1) the sealed source containing promethium-147 is a low-energy beta and gamma emitter and (2) its ultimate disposal was to a landfill and is covered with a signi6 cant amount of earth. However, any similar violations of this type in the future may resuh in additional enforcement action.
