Dear Mr. Lamberski:

This letter sets forth the Staff's position upon discovery issues recently discussed between us.

David Lewis wrote me on July.9, 1993, requesting that the Staff assist him in determining which documents obtaisied from Mr. Mosbaugh are listed ' on our response to your request for documents.

This is being done.

We expect to supplement our response to your request for documents with an additional identification of documents.

GPC wants access to all of Mr. Mosbaugh's oral and written statements to the NRC which are relevant to the SONOPCO and diesel generator issues, including handwritten notes where that is the only record of what was said by Mr. Mosbaugh,.and transcripts of Mosbaugh-NRC interviews.

In addition,. access is sought to the Mosbaugh tapes and transcripts which we are now withholding so as not to jeopardies OI's investigation.

You have asked for access to i

the foregoing materials when OI has completed-its investigation, prior to OI writing its final report.

Your request cannot be granted. Under Staff policy, after the Office of Investigations completes its report, the NRC Office of-Enforcement will review the report to determine if enforcement action should be taken.

If it is determined no enforcement action will be taken,. OI's report will then be made available.
