SACRAMENTO MUNICIPAL UTILITY-DISTRICT i
(Rancho seco Nuclear Generating. Station)
Docket ~No.

Dear Jim:
I have received your.~ letter, which was telecopied at 4:15-
[
p.m.,
on Friday, March 19, 1993.
(The' first 'page of your. letter:
incorrectly states the date to be March 18.)
our-letter to you of March 9, 1993, enclosing 13 documents i
constitutes full compliance with the commission's-order that.the District provide ECO with "all correspondence related to decom--
missioning and decommissioning funding submitted'to staff by or-on behalf of SMUD after-July 14, 1992."1/
Consequently, we do i
1/l Responding to footnote 1 of your letter, I disagree'with' f
your unnecessary observation.(see CLI-93-5, slip op. at 3 1
n.4) that'we made'a mistake-in representing-to'the Commis -
sion that none'of the documentation provided~on March 9.-
-l relates to the decommissioning funding plan.- The only remotely arguable exception, which you breezily label-an-example,' includes-one Staff question on ISFSI' costs.-
How--
i ever, spent; fuel disposition costs-are notl decommissioning l
i costs.- See 10-C.F.R..Su50.75(c) n.1.
Finally,;do not mis-lead the NRC by'beginning a~ sentence with the words, "As you; and I discussed......,*'followed by observations'which are-q

March 22, 1993 Page 2 not require your assistance; although we would be grateful if this type of wasteful correspondence could be avoided in the future.
Your efforts to " assist us" in complying with the Order would have been better spent looking at the documentation you already have, and at material in the NRC Public Document Room, where your personal view of relevancy may readily be applied.
Item No. 1 on the list in your March 19 letter would appear to be correspondence from me to the Atomic Safety and Licensing Board, dated July 15, 1992, forwarding information requested by the Board at the prehearing conference -- i.e.,
the District's April 15, 1992 response to the Staff's request for additional information.
My letter indicates that you were contemporaneously sent a copy of that letter and the enclosure!
Item No. 2 identifies three meetings you indicate took place between District and Staff personnel.
(a.)
The NRC Staff's Auguot 5, 1992 Summary of the July 15, 1992 meeting was sent to you by the Staff and includes a copy of the District's handout.
(which addressed the ISFSI application).
(b.) The NRC Staff's November 6, 1992 Summary of the October 27, 1992 meeting on the IsrSI application was sent to you and indicates that you were in attendance.
(c.) The NRC Staff's November 13, 1992 notice, a copy of which was sent to you, reflects that a meeting was to be held on November 18, 1992 at Lawrence Livermore National Labora-tory with SMUD and Pacific Nuclear to discuss the Dry Storage and Transport Cask System.
On November 19, the notice indicates that the group was to tour the Rancho Seco site.
These meetings do not relate to decommissioning or decommissioning funding.
These noticed meetings were postponed, and subsequently held on Decem-ber 15 and 16, 1992.
Itcm No.
5, DAGM/NUC-92-280, is one of the 13 documents we delivered to you on March 91 The other documents identified in your list are not related to decommissioning or decommissioning funding.
The Commission Footnote continued from previous page, yours alone.
I am sure you realize that it leaves the misimpression that I agreed with you.
You may believe that every bit of information related to the decommissioning plan affects funding.
The Commission, however, presumably was not wasting words when it singled out decocaissioning fund-ing in its Memorandum and order.

did not direct the Dir,trict to supply ECO with each and every piece of paper filed w hh the NRC.
You are always free, of
{
course, to examine these other documents at the PDR.
The fact is, however, that most of the District documentation in support of its proposed decommissioning plan'for Rancho Seco was on file
~
with the NRC well before July 14, 1992.
I Sincerely yours,-
