N FUND MECHANISM On July 25,1990,-you requested the answer to two, questions 'related to the b
stand-alone trust fund mechanism.
These questions are discussed below.-
1.
'Can.the Univ'ersity h' ave a provision in the trust agreement that.
_ expressly provides that all income and earnings on the assets deposited s
in the trust be payable to the University?
B-Yes,' the University may: withdraw income and earnings from the trust
. fund as long-as the. required financial assurance amount is maintained in L
the trust for decommissioning purposes.
2.
What numbers s_hould be' inserted into the second paragraph of-Section 5 of the-recommended wording for the trust fund agreement?
.We would find acceptable withdrawals from the Fund that do not exceed ten L
percent of the outstaading balance of the Fund.
A lower percentage number may be selected at your discretion.
