ENCLOSURE 1 NOTICE OF VIOLATION S. K. McBridge, Inc.
Docket No. 150-00032 Summerfield, North Carolina License No. 041-0766-1 During the Nuclear Regulatory Commission (NRC) inspection conducted on June 27, 1990, a violation of NRC requirements was identified.
In accordance with the
" General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1990), the violation is listed below:
10 CFR 150.20 recognizes Agreement State byproduct materials licenses, and-sets criteria by which these license holders may conduct the same work within NRC jurisdiction.
10 CFR 150,20(b) subjects Agreement State licensees working in NRC jurisdiction to the provisions of 10 CFR Part 71, Packaging and Transportation of Radioactive Material.
10 CFR 71.12 states that prior to first use of an NRC approved package for-which NRC has issued a Certificate of Compliance, a licensee shall submit to NRC his name, license number, and shall have a copy of the certificate of compliance, drawings,- and other references relating to the use and maintenance of the packaging and to the actions to be taken prior to shipment.
The licensee shall have an NRC approved quality assurance program.
Contrary to the above, as of June 27, 1990, the licensee had not
-registered with NRC to use the package authorized by NRC Certificate of Compliance - Number 9007, for Automation Industrias Model 520 gamma radiography camera and did not have the required drawings or references.:
The licensee had not registered a quality assurance program with NRC.
-This is a Severity Level IV violation.

Document Control Desk, Washington, DC 205o5, with a copy to the Regional Administrator, Region II, within 30 days of the date of the letter transmitting this Notice.
This reply should be clearly marked as a " Reply to a
. Notice of Violation" and should include [for each violation]:
(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the
.date when full compliance will be achieved.
Where good cause is shown, consideration will be given to extending the response time.
If an adequate reply is not received within the time specified in this Notice, an order may be l
