0.e MEETING TO DISCUSS THE EPRI ALWR REQUIREMENTS DOCUMENT On May 31,' 1990, representatives of the NRC, EPRI, NUMARC, and standard plant vendors met to discuss the status of the review of the EPRI ALWR Requirements Document for evolutionary light water reactors (LWRs). A list of attendees is enclo,ed.

EPRI indicated that'they felt the technical meetings that they have had with the staff during the last two weeks have been very fruitful toward giving them an understanding of the staff's positions on the open issues in the draft

- safety = evaluation report on Chapter 5 of the Requirements Document and the positions taken in SECY-90-016 " Evolutionary LWR Certification Issues and their Relationship to Current Regulatory Requirements." The applicant further indicated that they requested the meeting with the Connission on June 4,1990 because they wanted to make sure the Connission understood EPRI's )ositions on the matters in SECY-90-016 before the Connission voted on them. T1e staff-

' stated that it attempted to correctly state the positions of EPRI and the vendors in SECY-90-016 and during:its earlier meeting with the Commission.

-EPRI then stated that they are trying to obtain an industry-wide agreement on the resolution of licensing issues, but that they do not want to stand in the way of the certification of individual designs.

EPRI indicated that they are concerned that the staff may eliminate the " regulatory margin" built into design fectures offered in the future designs-by deciding to require those features in the design.

EPRI wants to be able to take credit for certain features currently not required by the NRC's regulations and regulatory policies,;but does not desire these features be made into NRC requirements.

The staffJindicated that it makes an integrated judgement on the safety of a

'desig'n based not on al1~ the features that are offered in a design, but rather upon those features that the Connission determines are required.

The staff has not adopted all the EPRI requirements because they do not fit into the staff's view of what is required for integrated safety. Many of the EPRI requirements are' good features to have in a design, but are not required for the plant to comply with the staff's safety requirements and policies. However, those items for which the staff requested the Connission to approve in SECY-90-016 are features that' the staff think appropriate to require even if the EPRI Requirements Document did nct exist.
