4 ENCLOSURE 1-NOTICE OF VIOLATION Edlow International Company Docket No. 70-1252

' Washington, DC

' During,tne Nuclear Regulatory Commission (NRC) inspection conducted on July 3-4, 1990, violations of NRC requirements were identified.

In accordance witr the " General Statement of Policy and Pracedure for NRC. Enforcement Actions," 10 CFR Part 2, Appendix C (1990), the Vi9ations are listed below:

10 CFR 73.37(b) and - (f) requires that a physical protection. system established and maintained or arranged for by the licensee of a irradiated fuel shipment shall provide for: notification cf the Nuclear hmlatory Commission in advance of each shipment and, notification of the sovernor or the governor's designee of a state prior to the transport.of spent fuel

Contrary to the above, on July 2,1990, a shipment of irradiated reactor fuel aboard the ship Alligator Independence was docked at the port in Wilmington, NC for approximately 11 hours1.273148e-4 days <br />0.00306 hours <br />1.818783e-5 weeks <br />4.1855e-6 months <br /> without advance notification to the NRC and the State of North Carolina.

This is.a Severity Level IV violation (Supplement III).

. hours to advise of the status of the shipment while the shipment vessel is docked at U.S. ports.

Contrary to the above, on July 2,1990, a shipment of irradiated reactor fuel aboard the ship Alligator Independence was docked at the port in Wilmington, NC for approximately 11 hours1.273148e-4 days <br />0.00306 hours <br />1.818783e-5 weeks <br />4.1855e-6 months <br /> without arrangements being made with. local law enforcement to provide response to emergencies or a call for assistance, and without calls being made to a communications center every two hours to advise of the status of the shipment.

This is a Severity Level IV violation (Supplement III).

Pursuant to the provisions of D CFR 2.201, Edlow International Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, DC 20555, with-a copy to the Regional Administrator, Region II, within 30 days of the date of the letter transmitting this Notice.

(1) admission or denial of the violation, (2) the reason for the violation if aamitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, :onsideration will be given to extending the response time.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified,.
