Dear Mr. Craft:
This letter responds to your June 25, 1990 letter appealing the agency's withholding of documents listed in Appendix F of our May 24, 1990 response t o FOI A 90-36.
The documents, consisting of three legal memoranda from the NRC's Office of the General Counsel to NRC officials, were withheld pursuant to Exemption 5 of the Freedom of Information Act (FOIA).
In response to your appeal, the withheld documents were again reviewed.
It has been determined that there has been a discretionary public release of the three withhold documents although they were otherwise withholdable pursuant to Exemption 5 of the FOIA.
In view of this prior release, it has been determined th?.t the three documents should be released to you.
Therefore, the records identified as Appendix items F-1 to F-3 are enclosed with this letter.
This letter represents final agency action on Appeal No. 90-A-32C.
