Enclosed is an application for an export license (XMAT0349), recently received by the Nuclear Regulatory Commission, for the export of nuclear grade graphite in the form of one fuel and one reflector test element.
Before taking action on this request, we would appreciate your views, in accordance with established procedures and from the overall perspective of the i
Executive Branch, as to whether the proposed export meets the applicable criteria in the Atomic Energy Act of 1954, as amended by the Nuclear Nonproliferation Act of 1978.
The Department of Energy has been requested to obtain the necessary assurance letter front EURATOM for the companion export license application (XSNM02557) for 50.76 grams of low enriched uranium (19.9%).
A copy of this application is attached for your information.
This is a replacement for export license XSNM02450 which expired before the material was ready for shipment.

Dear Mr. Peterson:
The U.S. Departnent of Energy (DOE) has arranged through the French Comnis-sariat a L'Energie Atctniqae (CEA) for a special irradiation test to be per-forned in the CCIEDIE experinental loop of the Siloe reactor in Grenoble, France. This test, a part of the DOS's National Modular HIGR Program, involves the irradiation of a fuel test element and a reflector test element for purposes of studying fission prcduct plateout/liftoit and washoff.. General Atomics (GA) is under contract with DOE to supply the small fuel and reflector test els:ents (one each) which are 6.1 on in dia:teter and 40 en and 47 cm in length, respectivel nuclear grade graphite, i.e.,y. These test elments are fabricated frczn Great Lakes Carbon Cmpany Grade H-451. The fuel test elmont will contain about 10 grams of U-235 in the fom of uranium-enriched to a mixinum of 19.9 w/o. The chemical fom of the uranium is uranium oxicarbide (UCO) which is physically in the fom of ceramic coated fuel particles fomed into bonded fuel empacts. Accordingly, enclosed are two ap311 cations for export licenses to France; one for the special nuclear materia., (i.e., 10 grams U-235) and one for the nuclear grade graphite (i.e., 4 kg H-451 graphite) conprising the fuel and reflector test element bodies. Please note that GA previously applied for and was granted export licenses XMM0340 and XSINO2450 in support of this program. Because of program delays, GA has a continuing need for such licenses and thus this request. If you have any questions regarding the above, please call ne at (619) 455-2823.
