Gentlemen:

l By letter dated April 30, 1990,~you submitted a statement of~ intent to show i

financial responsibility for decommissioning your facility which is licensed

under 10 CFR Parts 30, 40, and 70. This. letter addresses only the applicability of the financial assurance-requirements of 10 CFR 70.25-to Materials-License No. SNM-561. With regard to your licenses issued under 10 CFR Parts 30 and 40, your submittal will be addressed in separate correspondence.

In Materials License No. SNM-561, the De artment of the Army is authorized to possess sealed special nuclear. material SNM)'in.the form of sources, neutron-generators (batteries), and MTR. type fuel elements. Since licensees authorized to possess sealed SNM are not-addressed-in 10 CFR 70.25, we conclude that the~
