Let me iphasize that the U.S. Nuclear Regulatory Commission (NRC) fully recogniz s the need and importance of, as expressed in your letter, licensees having capability for interim storage of LLW while disposal capacity is develo d through the State's siting activities. Thus, the Commission approves o staff efforts to develop and issue guidance such as that in Information lotice 90-09, referenced in your letter, on interim storage of LLW. However, the Commission will not look favorably upon 1r79-term on-site storage beyond 1996. The Commission believes that storage should be viewed as a short-term int rim step between activities that generate waste and ultimate disposal. Thus long-term storage should not be looked at as a substitute to the developme t of new disposal capacity. The clear intent of the Low-Level Radioac ive Waste Policy Amendments Act of 1985 (LLRWPAA) is that States should take appropriate actions to assure that-disposal capacity is available by Januar 1, 1996. Thus, our statement on long-term storage beyond 1996 is consistent w h this deadline established by Congress. The Commission will con inue to follow progress of the States in developing new LLW disposal facilities. We will work to resolve emerging issues to help ensure a stable regulatory framework for safety and timeliness in NRC licensing actions to support State pr rams for LLW management consistent with the LLRWPAA.
