-l Cornell University submits th'e enclosed Decommissioning Report for. tlie two reactors owned and operated by Cornell, providing the information required by 10 CFR 50.75(d) in response to-I-

i a) a cost estimate for decommissioning the facility, b) assurance in the form of a ' certification that decommissioning funds will be available, and l

l c) a description of the means of adjusting the cost estimate periodically over the life of the facility.

With regr.rd to item (b) above and pursuant to 10 CFR 50.12, Cornell requests i

an exemption from the list of acceptable methods provided in 10 CFR 50.75(e)(2). In the report we request that Cornell University be exempted from the specific y.

' requirements of 10CFR50.75(e) (2) for reasons stated in the report which we believe K

fall within the scope of 10CFR50.12(a) (2) subsections (ii) and (iii).

< COST: ESTIMATES.

In renewal application material submitted in September 1980-for Loth reactors estimates were e

-provided for decommissionino costs in-1980. dollars.

The o

estimates were $420,000 for the TRIGA and $147,000 for the c'

.Zero. Power Reactor.

Based on those figures, and allowing for inflation and for increased demolition and removal: costs

-using currently acceptable methods and requirements, we estimate current costs under the DECON method to be

$1,300,000 and-$450,000 respectively.

The DECON method entails removal or decontamination of iocility components and structures to'a level that permits unrestricted use.,

. FINANCIAL ASSURANCE.

Cornell University requests exemption under 10CFR50.12 (a) (2) (ii) and (iii), from the requirements of providing assurance of availability of

' decommissioning funds by any of the three methods of 10CFR50. 75 (e)' (2) ;

i.e.,

pre-payment, an external sinking fund, or.a' guarantee method.

The basis for requesting i

exemption under 10CFR50.12 (a) (2) (ii)- is that Cornell University is a non-profit educational institution chartered in '1855 with 'a,large endowment and a long history of

. financial responsibility, and it is therefore not necessary; to require any of the named methods to achieve the underlying purpose of the rule.

The basis for. requesting

exemption under 10CFR50.12 (a) (2) (iii) is that nearly'all of i

the licensees for non-power research reactors similar to Cornell's that are required to submit a report under 10CFR50. 33 (k) (2) are Federal or State. government licensees who by the terms'of 10CFR50.75 (e) (2) (iv) are.not required-to 4

provide assurance by one of the three named methods but may use instead a statement of' intent indicating that funds for decommisc.sning will be obtaineo when necessary.. To require Cornell University to follow one of the three methods would impose costs sigaificantly in excess of those incurred by the L

governmental licensees.

They operate similar facilities in a similar manner for similar purposes.

ADJUSTMENTS OF CORT ESTIHATES AND FUNDING ASSURANCE.

n Cornell University c:ons not foresee decommissioning either reactor before the expiration of the current licenses in 2003.

The University will review the decommissioning plans and' cost estimates at intervals of not more than five years

- (e. g., 1995 and 2000) and will report at those times the

-adjusted estimates and eith4r comply with, or request exemption from, financial assurance requirements current rt the time of reporting.
