This is to inform the Consnission that a Notice of Violation and Proposed

-Imposition of Civil Penalty in the amount of $50,000 will be issued on or a

about July 23, 1990 to Northeast Nuclear Energy Company. This action is l

' based on the shipment of a package containing irradiated waste from Millstone

..to the Low Level Waste Disposal Site at Barnwell, South Carolina with free standing liquid-(water) in the package in, excess of the regulatory limit._ The '

adjustment factors in the Enforcement Policy were considered in determining the amount of this civil' penalty and the base amount of the penalty was mitigated 1 by-50% due to the licensee's corrective actions and escalated by 50% due to ithe licensee's )oor past performance in the area of transportation. No other W adjustment to t1e civil penalty was warranted.
