L Friday, December 8,1989, and the Staff seeks an additional two business days-until Tuesday, December 12, 1989 to file its responses.

L The Staff seeks this extension of time on two grounds: (1) the p voluminous nature of Intervennes' submissions make Staff response in the time provided impractical. and (2) the Staff was not properly served by the ,

Intervenor Massachusetts Attorney General'and did not receive his voluminous filings until four and a half days before the St.aff responses are due.

The Commission in an Order of November 16, 1989, provided that any party - seeking to stay the effectiveness of LBP-89-32, or seeking to

" supplement" a previously filed motion to vacate LBP-89-32, or seeking to make ~ ~"brief comments" pertaining. to the imediate effectiveness review of LBP-89-32, was to submit these pleadings by the eighth day following the LiceWng Board's issuance of an explanatory memorandum on its actions in LBP-88-32. ' initial pleadings addressing LBP-89-32 were to be filed by November 28, L 1989. Upon receipt of a " Motion for Clarification Or, in the Alternative, b

- Comments of the Town of Hampton Opposing Immediate Effectiveness of Licensing Board Decisions LBP-88-32, 89-32 and 89-33, December 1, 1989 (4 pages).

- Comments of Seacoast Anti-Pollution League Opposing Imediate-Effectiveness of Licensing Board Decisions LBP-88-32, 89-32, and-89-33. November 30, 1989 (33 pages).

These pleadings referred to and incorporated other pleadings which had been previously filed in this proceeding.

The Certificates of Service on the first three documents listed do not reflect that the Staff was served with those documents as required by .the ,

Comission Orders. The Intervenors have now filed.a Certificate of Service reflecting that the Staff was served with those documents on December _ 4, 1989, four days after that service was to be made. However, the Staff obtained _ copies of those documents before that service, about noon on December 4,1989, and had four days to prepare its response.

As can be seen by the extensive nature of the pleadings, they are apparently far beyond the "brief comments," a " supplement" to a 7 page motion to vacate and the 10.page motions to stay (see 10 CFR 6 2.788(b))

conNmplated in the Commission neder of November 16, 1989. The-NRC Staff could not reasonably be expected to respond meaningfully to these pleadings in-the four days it iias to prepare responses.

The NRC Staff has advised the attorneys for all other parties who have submitted' pleadings on the issue of the immediate effectiveness of LBP-89-32 of ' this = motion for a short extension of time, and the attorneys for the Applicants, the Massachusetts Attorney _ General and the Town of Hampton have indicated that they would have no ob,iection to the granting of this motion.

The attorneys for the Seacoast Anti-Pollution League and the New England Coalition on Nuclear Pollution expressed no opposition to the motion.
