TO THE APPEAL BOARD The Federal Emergency Management Agency (FEMA), through its undersigned counsel, respectfully offers the following comments concerning the' Licensing L

Board's recommendation that the questions previously referred to the Appeal

~ Board in'LBP-90-12 be' vacated.

FEMA agrees with the views of the Licensing Board, as stated in LBP-90-20, slip op at 9, that the sheltering issue remanded in ALAB-924.has.been ,

, resolved by the clarifica-ion of the State of New Hampshire and FEMA that

" actual sheltering" is not a part of NHRERP, Accordingly, FEMA agrees-that no further guidance is required from this Board to the Licensing Board as previously reglested and that the referrals should be vacated.
