- IMPOSITION OF CIVIL PENALTY - $75,000 By Ed 90-44 dated April 9, 1990 the Commission was notified of the intent of DE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the anount of $75,000 to Tennessee Valley Authority. This action was based on a violation involving the failure to adequately evaluate and correct a design deficiency at Sequoyah relating to the susceptibility of RHR pump deadheading during mini-flow conditions as discussed in NRC Bulletin 88-04.

The licensee responded to the Notice in a letter dated May 9, 1990, admitting the violations but requesting reconsideration of the escalation factor based on NRC identification. After careful consideration of the licensee's res>onse, the staff has concluded that the violation did occur as set forth in t1e Notice of Violation and Proposed Imposition of Civil Penalty and that the escalation factor was properly applied.

Accordingly, an Order Imposing Civil Penalty in the amount of $75,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
