To inform the Commission of the recent liberalization of the rules of the Coordinating Committee for Multilateral Export Controls (C0COM) and its effect on U.S. Government nuclear export controls.

l Backaround:

C0COM was created in 1949 by the members of NATO and Japan as an international export control group to maintain comme.i controls on exports of militarily strategic goods and commodities to the Eaet Bloc, China, and the Soviet Union.

The basic justificat'an for C0COM has been to prevent a strengthening of t b Soviet and Chinese military threat.

In light of the recent events in Eastern Europe, which have j- { ' t decreased the perceived military threat to Western Europe, European C0COM member countries have increasingly questioned the need for continued economic controls targeted against the East and have proposed substantial reductions in the C0COM list of controlled items. As a result, and with hi level U.S. Government concurrence, an entirely new " core"gh list of controlled commodities and goods is being developed which will replace the existing C0COM list by the end of the year.

Some C0COM-related U.S. export control requirements have already been relaxed by the Department of Commerce as indicated in the enclosed June 29, 1990 Federal Register Notice.

Discussion:

The C0COM decontrols have importan_t implications for nuclear non proliferation export controls. A number of dual-use items controlled by the Department of Commerce, including some items controlled for nuclear non-proliferation reasons, either will be completely' decontrolled or substantially altered. This will adversely affect.the ability of nuclear supplier countries to control such items since the C0COM export control list also, in practice, has been used by many countries as the legal basis for controlling exports of dual-use items (e.g., computers) to proliferation-sensitive countries.

For example, if decontrolled, such dual-use items could flow freely regardless of destination because the new governments may not have the infrastructure M place to control effectively their reexport to countries of s proliferation concern such as Iran, Iraq, India, Pakistan, Syria, Libya, Argentina, and Brazil. To address this issue, a separate list is being developed by U.S. Government nuclear non-proliferation officials, including NRC, to cover items which should continue to be controlled for nuclear non-proliferation reasons.

The U.S. Government will urge that other countries adopt appropriate regulations to assure effective and uniform multilateral export controls over these items.-
