. Rommissioner Remick's Comments on SECY-90-16 I-approve the staff's request'to publish the proposed' rule on nuclear power-plant license renewal and the supporting documents.
Although I do not have comments at this time which I feel must be addressed:before publishing the proposed rule, I want to suggest several issues which I think should be reexamined before the Commission prepares to act on the final rule.
First-and most importantly, the staff should clarify its interpretation of the relationship between the design basis and the current. licensing basis.
Additionally,LI would like to more fully understand how each will be compiled and managed.
Section~4.2.3.2.1 of the Regulatory Analysis accompanying the
~
rule indicates that a large part of the effort required to compile the current licensing basis will be the applicant's effort =to document the current design basis.
It is not entirely clear to what extent the staff expects the applicant to physically reassemble the design basis and the licensing basis in order to meet the license renewal requirements.
Section 54.21(a) of the rule requires that each license renewal applicant shall' identify and compile in an auditable and retrievable form the current licensing basis.
I do not believe the staff intends that the licensee reassemble all commitments-and so forth in a separate document for the NRC to audit.-.The rule should more clearly state that the licensee is required to identify how it will determine what documents the current licensing basis. includes. This may be done by describing a procedure or identifying existing procedures, that will-be made available for NRC to audit. Such a procedure might, for example specify an already! existing system"for tracking commitments which will be reviewed by the licensee to determine if any age sensitive commitments are included.
The rule'should not require a republication of the comm.cments in some new physical document when such republication is unnecessary for our review; Second, 10 CFR 2.109 (b) and 10 CFR 50.54(bb) require a licensee to file sufficient application for renewal purposes.
I am not sure,the appearance of the word " sufficient" in the APA is a reason to intreduce a new issue into the license renewal provisions.
I believe Chairman Carr's suggested changes help clarify this issue, but I am not yet convinced his suggested language will prevent litigation over whether an application is
" sufficient" to trigger the continued operation provisions for timely renewals.
As the regulations currently stand-an
< application will not receive a docket number until the Director of NRR has determined that the application is complete and acceptable for docketing purposes (10 CFR 2.101(a,(3)).
It is not clear to me what if anything, addition of the word
" sufficient" will add to this process.

. Also, with regard to Chairman Carr's comments on the
. enforceability of the current licensing basis, it was my understanding that OGC believed language could be developed which would maintain the_ current status of all items in the CLB during the renewal-period.-
In other words, commitments would continue as commitments (and therefore1 unenforceable) in the rer.ewed license, while requirements from the regulations, license provisions, and any applicable orders would continue as requirementn (and therefore enforceable) in the renewed license.
1 I believe it would be preferable to develop such language for renewal purposes.
If the staff sees a need to.make-a commitment intora reqv.irement, the regulations provide' adequate mechanisms' outside of111censo renewal to impose such requirements.
I should add that if we were to convert a commitment into a requirement through the license renewal process, such a conversion would be subject to the backfit requirements.
Third,;I agree with the staff that consistency between license
. renewal efforts and Maintenance Standard Development'is very important. _As the staff has stated,' careful coordination is necessary in the development of a maintenance regulatory guide or standard to-ensure that elements that relate to.recordkeeping,
-trending, and surveillance import it to license renewal 'are considered.
I would-like to reemphasize that the staf f-address license renewal considerations.within the context of any other-ongoing maintenance related activities.
Finally, I noted some sections of the rule in which words and
. terms <used seemed'to be inconsistent.
I have attached the pages where.I think words should be changed.
